Terms and Conditions

These Terms and Conditions apply to programs operated by Homeroom Education, INC. (referred to as “Homeroom Education”) including but not limited to Classes, Makerspace, Workshops, Excursions, Community events, website and social media pages, and sponsored or featured programs. These terms apply to all courses, options, programs, websites, and social media pages offered or managed by Homeroom Education.

By agreeing to these Terms and Conditions and/or registering my student for a Homeroom Education program, I assert that I have read all Terms and Conditions and agree to be bound by them.





Indemnification Agreement

I agree to defend, indemnify, and hold Homeroom Education, INC/Homeroom Education, its officers, directors, employees, and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable attorneys’ fees and costs, arising out of or in any way connected with mine or my student’s participation in a Homeroom Education program.


Arbitration Agreement

I agree that any dispute arising out of or relating to this Agreement, mine or my student’s participation at Homeroom Education, INC, or otherwise arising between the parties, including, without limitation, any students statutorily created or protected rights, as permitted by applicable state/provincial or federal laws, may be settled by arbitration in the state/province and county in which the program is held, in accordance with the Commercial Rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrator(s) may be entered in any court of competent jurisdiction. The prevailing party in the arbitration shall be entitled to recover expenses including costs and reasonable attorney’s fees associated therewith. Should any part of this contract be found invalid or not enforceable by a court of law, then the remaining portion shall continue to be valid and in force. I hereby acknowledge that I understand the terms of this ARBITRATION AGREEMENT and agree to comply with all of its terms and provisions.


I certify that I have read through, understand, and agree that I and my student will be held to the Terms and Conditions set forth below. I also agree that I have reviewed the Terms and Conditions with my student. I understand that I and my student must act in a way that is in keeping with the Terms and Conditions and that my student can be dismissed from a program if either of our actions or attitudes seem to be harmful to the atmosphere, other students, or staff, in the opinion of Homeroom Education staff. I and my student understand that Homeroom Education reserves the right to dismiss my student from the program without any prior warning for violating any of the provisions of the Terms and Conditions. Refunds will not be given for students dismissed for failure to abide by the Terms and Conditions. I also acknowledge that upon staff observation of my student at any Homeroom Education program, the Instructor may determine that the program is not a suitable and/or productive environment for my student. In this case, Homeroom Education may dismiss the student and no refund will be issued. Homeroom Education will exhaust every opportunity for an excellent relationship with every student. However, in some rare cases, Homeroom Education may not be a compatible environment for every student.

Code of Conduct

Students and Parents/Guardians May NEVER:

1.  engage in or threaten violence;

2.  bully, intimidate, or harass others;

3.  damage facilities or equipment;

4.  sexually harass others;

5.  smoke, use tobacco, or vape products at Homeroom Education locations or the locations of our partners;

6.  use, possess or be under the influence of alcohol, marijuana, illegal or un-prescribed legal drug (If a student is caught using, possessing or being under the influence of illegal drugs, student will be immediately dismissed and permanently banned from all Homeroom Education facilities and may be criminally prosecuted. If a student is suspected of possession of alcohol, marijuana, illegal substances, the student may be subject to search and seizure);


Students Also May NEVER:

1.  view pornography or any inappropriate material (including sexual content, inappropriate violence, racism, bullying, etc.) on the Internet;

2.  steal property of others (If a student is suspected of possession of property which is not their own, the student may be subject to search and seizure);

3.  inappropriately use equipment;

4.  engage in internet hacking;

5.  use or possess weapons (If possession of weapons is suspected, student will be subject to search and seizure. If a student is found in possession of a weapon student will be immediately dismissed immediately and permanently banned from all Homeroom Education programs);

6.  bring pets or animals to any Homeroom Education program. (Service dogs may be permitted);

7.  bring drones, hover boards, roller blades or shoes with wheels;


Students and Parents/Guardians MUST:

1.  abide by the rules and regulations of each location and partner locations;

2.  respect facilities and property; (Should intentional damage to facilities or property be found to be inflicted by a student, the student and their parents will be responsible for fines and damages.)

3.  not hold Homeroom Education responsible for any lost, stolen or damaged personal items;


Students Also MUST:

1.  be responsible for all materials issued to them;

2.  not use personal electronic devices during instructional time – unless they are approved by the instructor (it is recommended that personal devices be kept in a back pack. Also, if student accesses the Internet via a local Wi-Fi hotspot at the program location it is the sole responsibility of the student and student’s parent/guardian to comply with all providers’ terms & conditions, and assume all financial risk.


Changes, Cancellations, and Refunds


1.  Changes: I understand and agree that I am, without penalty, able to make changes to my student’s enrollment including but not limited to location, date or program, so long as the changes are made more than 1 week (7 days) prior to the start date of the originally scheduled program my student was enrolled for, subject to availability. If there are seven (7) days or less until the start of the originally scheduled program, I agree to pay a $5 fee when changing to a different session, location, or program for any Homeroom Education workshop, excursion, or event, subject to availability.


2.  a) Cancellations by Parent/Guardian: I understand and agree that I may only cancel my student’s enrollment until seven (7) days prior to the start date of the program for which my student is enrolled. I must make my cancellation through an email to Admin@HomeroomEducation.com (please note “Cancellation” in the subject line). If my student cannot attend a session for which they are enrolled and I do not notify Homeroom Education more than seven (7) days prior to the program session date, it will be considered a withdrawal/no show and I will be responsible for full payment of all fees associated with my student’s registration for that event. NOTE: If a medical emergency occurs less than seven (7) days prior to the start of the program in which your student is registered, preventing your student from attending the program, please call (408) 915-5486 and we will work with you to try to get your student enrolled in another course.

4.  a) Charter Schools: If my student’s enrollment fee has been paid for, in part or full, by a Charter School, and I cancel my student’s registration through email as set forth above, more than seven (7) days prior to the start date the session I am cancelling, I understand and agree that the amount I paid for the cancelled enrollment, will not be Invoiced to the Charter School. I agree that I will be financial liable, and will receive an Invoice for the enrollment fee of, any cancellations made less than seven (7) days prior to the start date of the session cancelled, and improperly made cancellations. I also understand and agree that I will be personally financially responsible and Invoiced for early withdrawal or dismissal due to absences (for any reason) including sickness, behavioral dismissals, power failures, weather, and unforeseeable events not within the control of Homeroom Education or other acts of nature that are not covered by my Charter School.

b) If students leave a program early for any reason, the enrollment fee is not prorated and no refund will be issued, including partial refunds. If Homeroom Education must cancel a session and cannot find a suitable alternative, no Invoice will be sent to the Charter School.


Health and Safety

I understand that physical and recreational activities contain inherent risk of injuries.

I certify that my student is in good health and able to participate in Homeroom Education programs, and that if for any reason my student should be restricted from participating in any activity, that it is my responsibility to notify Homeroom Education staff of such restrictions via email or a phone call within 72-hours (or 3 business days) of enrollment, but no fewer than 48-hours prior to the start of the enrolled program.

I authorize Homeroom Education staff to attend to any health issues or injuries my student may incur while participating in a Homeroom Education program. This includes providing basic first aid, administering authorized medications, and seeking emergency medical care for my student should they deem it necessary.

I agree to be financially responsible for any medical treatment needed during the duration of the program. I understand that I am responsible for providing the sole insurance coverage for any medical treatment my student receives, and agree to release any and all records necessary for my student to receive medical treatment.

I understand that after registering, it is my responsibility to contact Homeroom Education to provide them with any relevant medical history that may impact my student’s participation in a Homeroom Education program. I understand that as a condition of enrollment, I as my student’s parent/guardian, will need to contact Homeroom Education with any relevant medical information within 72-hours (or 3 business days) of enrollment. If I enroll my student in a Homeroom Education program less than 72-hours prior to the programs start, I recognize that it is my responsibility to contact the Homeroom Education staff within 24-hours to provide any necessary medical information. I understand that if I do not accurately and completely inform Homeroom Education of any necessary medical information about my student prior to the start of the Homeroom Education program, my student’s participation in the program may be withdrawn, altered, or canceled as determined by Homeroom Education staff and no refund will be issued.

If my student needs to bring any medications to a program, I agree to contact Homeroom Education staff according to the above timeline to fully discuss and disclose the medication. I agree to receive permission from Homeroom Education management before bringing medication to any programs. If permission is granted, I agree to bring all medications in original containers that identify in English the prescribing physician (if a prescribed medication), the name of the medication, the dosage, any side effects, and the frequency of administration. The information dosage and frequency of administration on the bottle must match the information provided to Homeroom Education management. I agree that all medications, except inhalers and diabetic testing kits will be given to and administered by Homeroom Education staff.

I understand that it is my responsibility to retrieve all medications brought to a program by my student from Homeroom Education staff at the end of my student’s program.

Epipens, Insulin, & Inhalers

Students with prescribed Epipens are required to bring two non-expired Epipens every time they attend a Homeroom Education program. One Epipen will be kept with the student, and the other with a Homeroom Education staff member.

Students with prescribed Insulin injections will be required to store their insulin with Homeroom Education staff members. If necessary, refrigeration is available for programs offered at the Homeroom Education Learning Center, but may not be available at other program locations. Students may keep their testing supplies with them. Students who need to administer their insulin during a Homeroom Education program must be able to measure and administer their medication themselves under the supervision of a staff member. Homeroom Education staff members are not trained and cannot be held responsible for, the administering of injectable insulin. If a student is unable to administer their own insulin, the parent/guardian may be required to do so for them as a condition of enrollment.

Students with prescribed inhalers will be allowed to keep their inhalers with them. However, if parents/guardians believe that their student may suffer an attack that would require assistance in administration then an additional inhaler must be brought to the program and kept with a Homeroom Education staff member. In such cases, Homeroom Education management may also require parents/guardians to provide an inhaler attachment that will cover the nose and mouth, making assisted administration easier. Parents/guardians are responsible for informing Homeroom Education staff members, in advance of the enrolled program, of any events, activities, or interactions that may trigger an attack requiring the use of the student’s inhaler.

Please Note: students will be required to self-administer all injectable medications under the observation of staff. At the end of the student’s program, parents/guardians are responsible for retrieving all medications from Homeroom Education staff.

I understand that Homeroom Education staff cannot give my student over-the-counter medication without my written permission.

I agree that if my student’s medication is left at a program after my student’s program session has ended, that Homeroom Education has the right to dispose of any medication left and shall not be responsible for any damages or liabilities related in any way to such medication, including, but not limited to, replacement cost of the medication and any damages resulting from student’s failure to administer such medication.

I understand that the Emergency Contact I provide must be at least 18 years of age and must reside in the United States.



Special Accommodations

If your student requires any special accommodations in order to participate in Homeroom Education activities, you must call Homeroom Education at (408) 915-5486, no less than 2-weeks prior to your student’s enrolled program. Homeroom Education will work with you to identify available reasonable accommodations. If your student requires an aide at school then he/she will need to be accompanied by an aide at the Homeroom Education program, and that aide will need to be present for the duration of the session. The aide must be age 18 or older, may be a family member if currently trained and acting as the student’s aide, and must achieve a favorable result on a criminal background check, as well as interview with the Homeroom Education management team prior to attending Homeroom Education programs. They may also be subject to fingerprinting. You will be responsible for all direct costs, including background check processing fees, for the aide’s attendance.


Program Activities

Tuition: Tuition includes all state/province and federal taxes, adult supervision, instruction, Flex Hours, curriculum materials (unless otherwise stated), and recreational activities.

Photos: As a condition of participation, I authorize that photos, videos, images, audio and testimonials may be taken of my student and agree that said content may be used by Homeroom Education in promotional materials, marketing collateral, and online media. These images, testimonials, photos, videos, and audio may be shared and used by corporate partners, the media, or other organizations who work with Homeroom Education. I understand that Homeroom Education, its owners, agents, partners, facility providers, and employees will not be held liable for damages and injuries associated with said publishing, including any and all claims based on negligence. I agree that all images, testimonials, photos, video, and audio taken at or in connection with Homeroom Education are the sole and exclusive property of Homeroom Education.

Press Visits: Please note that if Homeroom Education is contacted by the press, a student’s full name may be used in print, radio, TV and other mediums. We may not have the opportunity to contact all families for permission before the press arrives. Therefore, we have created a blanket policy. We thank you for understanding.

Projects: I understand that when applicable, Homeroom Education makes a reasonable effort to send each student home with program projects, or to post the project to a project website. However, I understand that there will be instances when the project will not be finished or work properly. Therefore, I release Homeroom Education from any responsibility for non-functioning/non-compatible/non-complete program projects. Homeroom Education staff will provide each student with their completed, or in progress, project at the conclusion of each program. Refunds will not be issued for non-functioning/non-compatible/non-complete projects. I also agree that all projects and work created while at Homeroom Education may be used by Homeroom Education in promotional materials, online, and other print media and may be shared and used by corporate partners, the media, or other organizations who work with Homeroom Education. I agree that Homeroom Education, its owners, agents, partners, facility providers, and employees cannot be held liable for damages and injuries associated with said publishing, including any and all claims based on negligence.

Movies: I understand that movies played at any of the programs run by Homeroom Education are rated PG and PG-13 and selected at the sole discretion of Homeroom Education staff.

Software Accounts: I understand that some Homeroom Education programs require creation or use of an online account during instructional time, or for continued work on program projects at home. I give consent for Homeroom Education to create account(s) as needed for my student to participate in Homeroom Education program activities.

Game Ratings: I understand that while Homeroom Education takes its corporate responsibility and Homeroom Education family values very seriously, it cannot guarantee that younger students at Homeroom Education will avoid complete contact with games rated “T” for Teen, or “M” for Mature. Homeroom Education will make a concerted effort to minimize exposure to any games not appropriate for these age groups. I also understand that if a student is attending a course designed for ages 13-18, some of the game titles my student may be exposed to are rated “M” for Mature by the ESRB (Entertainment Software Rating Board). In exchange for my student’s participation in Homeroom Education programs, I voluntarily assume any and all risks, known or unknown, associated with my student’s access to “M” rated game content at a Homeroom Education program.

Inappropriate Web Content: I understand that Homeroom Education makes every reasonable effort to prevent participants from being exposed to inappropriate web content. However, I understand that when required by a program, students will bring and use their own, private, laptops, tablets, and phones which may be able to access inappropriate content. While Homeroom Education utilizes software and firewalls to prevent the accidental viewing of inappropriate material on any Homeroom Education owned and managed devices, I agree that no software is 100% perfect, that Homeroom Education is unable to control the content on student owned/operated hardware, and that my student may inadvertently access some inappropriate content even though Homeroom Education takes reasonable precautions to guard against inappropriate material being viewed. I understand that if inappropriate content is viewed, Homeroom Education staff will follow standard protocol and agree that if my student is found in violation of the Code of Conduct set out above, my student may be removed from a program without receiving a refund.

Location Specific Terms: Homeroom Education offers programs and activities at a variety of locations across the Bay Area. I understand that when participating in a program that is not located at the Homeroom Education Learning Center additional TERMS & CONDITIONS, specific to the location where the program is being held, may apply. I understand that Homeroom Education, if not required by the program location, may not make me aware of additional Terms & Conditions, but rather, that is it my responsibility as the participant, or parent/guardian on a student, to familiarize myself with the policies of a program location. Therefore, I agree that Homeroom Education, its owners, agents, partners, facility providers, and employees will not be held liable for any claims, liabilities, damages, losses, and expenses due to mine or my student’s violation of a locations Term’s & Conditions.

Sign Out

Self Sign-Out Policy for Young Adult Programs: I agree that if my student is registered for a course published for ages 13+, he/she can sign himself/herself out with staff at the conclusion of the program. Once my student signs themselves out, they will no longer be in the care of Homeroom Education. I agree that if my student, even if under the age of 13, is enrolled in a course published for ages 13+, this policy still applies.

Sign-Out Policy for Youth Programs: I agree that if my student is registered for a course in the 12 and under group, this means he/she must be signed out of their Homeroom Education program by an authorized pickup person. I understand and agree that only those named as an additional authorized pick-up persons (and who show a valid picture ID, Driver License, or Passport)—will be able to pick up my student. I understand that if I grant my student permission with Homeroom Education management to be cleared for “self sign-out”, that once my student signs himself/herself out, he/she will no longer be in the care of Homeroom Education.


Age Policy

I understand that Homeroom Education offers programs designed for students up to the age of 18, and under certain circumstances or in designated programs, may permit the attendance of parents/guardians who are age 18 or older. I understand, that in these circumstances students under the age of 18 may interact with participants over the age of 18 throughout the duration of each program session. I understand that by registering for a Homeroom Education program that accepts students/participants over the age of 18 my student may interact with a student that is 18 years of age or older. I also agree that if my student is 18 years old, or if I as the parent is participating in a non “Family” designated program, that he/she or I must successfully pass a criminal and sexual offender background check, prior to being allowed to attend a Homeroom Education program. I agree to be responsible for all costs and fees associated with any background checks required for my student or me to attend.


Payment Policy

US Dollars: I agree that all financial transactions are made and quoted in U.S. Dollars.

Non-Refundable Fee: To cover the administrative costs associated with registering my student, I agree that where advertised and applicable for Homeroom Education programs/courses/events that my student is registered in, a disclosed per student, per program minimum required deposit of the total payment amount is non-refundable and non-transferable.

Charter Schools: If a Purchase Order from a Charter School is being used to pay for all or part of my student’s program fees, I understand that I will be responsible for any amount, in total or part, that the Charter School refuses to pay. I agree to pay all fees including, but not limited to, tuition, upgrades, meals, and/or supplies that my Charter School refuses to pay, or disputes, for any reason. I understand that an Invoice for any fees not covered by my Charter School will be issued to me between 30-60 days after the completion of my student’s program and that I must submit payment to Homeroom Education within 30-days of receiving the Invoice. 

Late Fees: If I do not pay the total cost of my student’s program(s) at the time of registration, I understand and agree that I must pay the total amount due on or before the date of the registered program. If the total balance is not received by the start of the program, I understand and agree that I will pay a $25 late fee. If my full balance is not paid by the program start time, I agree that my student’s registration will be cancelled without a refund.

Returned Check/Dishonored Transaction Fees: A $25 returned check fee will be assessed for any checks returned or card transactions that are not honored.

Promotional Specials: I understand that not every transaction or enrollment is elidable for a promotional discount and that if I use a promotional discount when registering my student, that I am limited to one discount per student, unless otherwise stated, and that the balance must be paid in full at the time of registration to receive the published discount amount. I also agree that all applicable cancellation/refund policies apply, and that all promotional codes must be submitted at the time of registration. I understand that Homeroom Education will not honor retroactive adjustments and that the total discounts received cannot exceed the total cost of the products purchased.

a)    Multi-Course Discount: If I register and pay for more than one student or register one student for multiple Homeroom Education programs/courses IN THE SAME TRANSACTION, I understand that I will be responsible for paying the standard tuition for the first program/course, but will receive a discount of $10 for all Homeroom Education programs/courses, other than designated Excursions, for each additional program/course tuition paid. I understand that the lowest discount amount will be applied if I qualify for multiple discounts.


b)    Refer-a-Friend Discount: If I choose to participate in the Refer-a-Friend program, I do so voluntarily and understand and agree to the following:

i.    My referral code can be used an unlimited number of times.

ii.    For each new student that registers for any Homeroom Education program/course using my referral code and attends the course for which they registered, I will receive a $5 Homeroom Education program tuition credit which I must use toward my next program tuition. My friend will also save $5 off their program tuition. The referred student must be a new student and cannot have previously attended any Homeroom Education programs.

iii.    Referral codes must be used at time of registration payment and cannot be retroactively applied.

iv.    Referral codes can only be used once per student. I understand that Homeroom Education will credit the referral based off of the referral code that the new client provides at the time of registration.

v.    The Refer-a-Friend program does not apply to siblings (since they are eligible for the Multi-Course Discount).

vi.    Students may not refer each other to both qualify for the Refer-a-Friend Discount.

vii.    The tuition credit will be applied within 3-5 business days from the time the referred client registers and pays in full, or sooner. If the referred friend cancels his/her session, the credit will be removed from my account and I will be responsible for any account balance that is created as a result of the lost credit.

viii.    All tuition credits must be used toward the next program enrollment after they are earned, cannot exceed the total tuition due at time of payment, and will not entitle me to any form of payment. If I cancel or change the registration of a course in which I used a Refer-a-Friend program tuition credit, I am subject to the terms and conditions set out above, and will only receive refund of amounts paid directly by me. I will not receive a refund of tuition credit amounts.

ix.    Credits can only be used toward Homeroom Education program tuition fees.


c)    Certificates/Vouchers: All certificates/vouchers are non-refundable, non-transferable and not redeemable for cash. Certificates/vouchers must be redeemed at the time of registration. Location and date is based on availability at the time of registration. Certificates/vouchers are valid until the specified expiration date, without exception. They are valid for up to the amount/terms issued, and any amounts not used are forfeited.


Rights Reserved

Homeroom Education, INC reserves the right to update or modify these Terms and Conditions at any time. We reserve the right to cancel a program if participation numbers are not adequate. In the case where a suitable Homeroom Education replacement program is not found, a full refund will be issued. On rare occasions, the software and hardware we use at our programs may change without notice, and we will strive to find suitable software and hardware alternatives.


Privacy Policy

I have read, understood and agree that I and my student are bound by Homeroom Education’s privacy policy.

I understand that Homeroom Education partners with and uses the intellectual property of third party vendors, service providers, and other companies. I agree to uphold the copyright and trademark rights of Homeroom Education and their partners including, but not limited to, those listed on the Homeroom Education website.
